These Terms and Conditions (“Terms”) govern the provision of residential construction services by TIGER LIVING PTY LTD (“we”, “us”, or “our”) to you, the client (“you” or “client”). By engaging our services, you agree to be bound by these Terms.

1. Scope of Work
• The scope of work will be outlined in your formal building contract, plans, and specifications.
• Any work not explicitly included is deemed excluded and may require a variation.
• TIGER LIVING PTY LTD reserves the right to adjust pricing, timelines, and specifications where required due to regulatory changes, material availability, or site-specific factors.

2. Quotations and Pricing
• All quotes are valid for 30 days unless otherwise stated.
• Quotes are subject to change based on site conditions, client variations, or third-party changes.
• Pricing may exclude certain costs such as landscaping, council fees, site remediation, and engineering unless clearly listed.

3. Variations
• All requested changes after the contract is signed must be submitted in writing.
• Variations may incur additional costs and time extensions.
• No variation will be undertaken without client approval and signed acceptance.

4. Payment Terms
• Payment terms will follow the agreed construction schedule outlined in your contract.
• Payments are due as per milestone completion or progress claim invoices.
• Late payments may attract interest charges and may result in work suspension until payment is received.

5. Site Access and Responsibilities
• The client must provide safe and clear access to the site throughout the construction period.
• The client is responsible for ensuring the site is legally suitable for development (e.g. no encumbrances, easements, or zoning issues).
• Any site conditions that delay or obstruct works may result in additional charges.

6. Custom Builds and Selections
• Custom design choices (e.g. fixtures, fittings, finishes) must be finalised by deadlines advised by TIGER LIVING PTY LTD.
• Delays in client selection or late changes may affect delivery timeframes and cost.

7. Owner-Supplied Items
• Owner-supplied materials must meet relevant standards and be available on-site at agreed times.
• We are not responsible for installation issues, delays, or failures caused by client-supplied items.
• Warranty on owner-supplied items remains the responsibility of the client and/or product manufacturer.

8. Delays and Unforeseen Events
• TIGER LIVING PTY LTD will take reasonable steps to complete work on time; however, delays may occur due to weather, supply chain disruptions, council delays, labour shortages, or other unforeseen events.
• We are not liable for delays outside our reasonable control.

9. Warranties and Defects
• Work is covered under statutory warranties as required by the Queensland Building and Construction Commission (QBCC) and the Home Warranty Insurance Scheme.
• Any defects identified within the defects liability period will be repaired in accordance with the contract terms.

10. Council Approvals and Compliance
• We will assist with obtaining council approvals as agreed in the contract.
• Final approval remains the client’s responsibility unless stated otherwise in the agreement.

11. Intellectual Property
• All designs, drawings, plans, and specifications provided by TIGER LIVING PTY LTD remain our intellectual property unless transferred by written agreement.
• Clients may not reproduce or share our intellectual property without prior written consent.

12. Limitation of Liability
• To the extent permitted by law, TIGER LIVING PTY LTD is not liable for indirect, incidental, or consequential loss arising from our services.
• Our total liability is limited to re-supplying the services or refunding the amount paid for the affected portion of the work.

13. Termination
• Either party may terminate the agreement under the conditions outlined in the contract.
• Upon termination, the client is responsible for paying for all work completed to date, including approved variations.

14. Privacy
• All personal information collected is handled in accordance with our Privacy Policy and relevant Australian privacy laws.

15. Governing Law
• These Terms are governed by the laws of Queensland, Australia. Any disputes shall be resolved in accordance with Queensland law and through the relevant dispute resolution channels (including QBCC where applicable).
